Junzhiquan successfully settled the dispute over necessary patent right (SEP) between Huawei and Samsung
2019.03.04
Recently, Huawei and Samsung have reached a comprehensive settlement on their nearly three-year dispute over a series of SEP (Standard Essential Patent)/NSEP (Non-standard Essential Patent) infringement cases.
Among them, six (6) SEP cases represented by Junzhiquan and tried by the Shenzhen Intermediate People's Court (hereinafter referred to as the "SIPC") have been rounded off as well. Junzhiquan worked closely with Huawei to delve into relevant hot legal issues, ravel out complicated case details, and wrestle with technical difficulties, chalking up victories in several cases.
1. When dealing with the Patent Reexamination Board, all of the six (6) SEPs represented by Junzhiquan remained valid.
2. When dealing with the SIPC, Junzhiquan won the lawsuit in the first SEP case ((2016) Yue 03 Minchu No. 840) (the remaining five cases had not been tried), and the court upheld Huawei's claims and ordered Samsung to immediately cease infringing Huawei's patent (No. ZL201010137731.2) by means of manufacturing, selling, offering to sale, and using the relevant products.
These key victories had beefed up Huawei's advantages in the negotiation process of all relevant cases and paved the way for the eventual triu mph over the cases.
Committed to providing excellent and efficient legal services in a professional, rigorous manner, Junzhiquan will continue to leverage its technology-powered legal advantages to protect IPs for more companies and help them sharpen their competitive edges.
